The State Service on Control and Regulation in the Field of Transport is a state control body in the transport sector, monitors compliance with regulatory legal acts in the field of automobile, water, electric, railway, industrial and road transport and regulates their activities.
It is worth noting that the issue of protecting highways from premature breakdowns and regulating the activities of their users is one of the main activities of the service. It is thanks to strict control over compliance with the rules of operation that we can guarantee the durability and safety of roads for a long time.
It should be emphasized that the protection of highways from premature wear and strict regulation of user activity are at the center of the service. This step, within the framework of the instructions and instructions of the Founder of Peace and National Unity, Leader of the Nation, President of the Republic of Tajikistan Emomali Rahmon, is vital not only for maintaining the quality of road infrastructure, but also for the economic efficiency of the industry and reducing repair costs.
The service strives to maintain the technical condition of roads at the proper level through the introduction of modern monitoring technologies and compliance with weight and size standards.
Because roads are not only a means of transportation, but also precious capital, the maintenance of which requires serious responsibility.
It should be noted that the main reason for the breakdown of highways and the appearance of potholes is the movement of cargo vehicles weighing more than the established norms, and in order to maintain and extend the service life of roads, it is mandatory to ensure control of the weight and size of cargo vehicles and citizens’ compliance with legislation.
After all, road protection is not only the duty of the state, but also the duty of every citizen, and failure to comply with the norms of weight and size of cargo entails large budget expenditures and danger to people’s lives.
In this regard, in accordance with parts 1 and 2 of Article 82 of the Automobile Transport Code of the Republic of Tajikistan dated April 2, 2020 № 1689, the shipper is obliged to prepare the cargo for transportation in such a way as to ensure the safety of transportation and the safety of the cargo, as well as to prevent damage to highways and vehicles, and loading into a motor vehicle is carried out by the shipper in compliance with the standards of volume and weight., To establish the Resolution of the Government of the Republic of Tajikistan dated December 29, 2006 №779 “On approval of the Rules of movement on highways of vehicles weighing and measuring exceeding the established norms” and other regulatory legal acts.
As in accordance with paragraphs 9, 10 and 11 of this article, the shipper, the recipient and the owner of the cargo are required to determine the weight of the cargo in the presence of the carrier and to indicate the weight of the cargo in the consignment note, indicating how it is determined by the shipper, as well as to accept small-scale cargo for transportation, indicating the weight of the cargo and the number of cargo packages in the bill of lading.
At the same time, in accordance with part 2 of Article 83 of this Code, the carrier, under a cargo transportation contract, is obliged to monitor the placement and securing of cargo in order to comply with established norms for loading a vehicle, ensuring road safety and transportation, ensuring the safety of cargo, highways and property of third parties.
In order to ensure the enforcement of regulatory legal acts of the Republic of Tajikistan, the shipper, the recipient and the owner of the cargo are obliged to carry out the transportation of heavy and bulky goods in compliance with legal provisions and not to damage highways.
In this regard, all shippers, consignees and owners of goods are asked and required to carry out their activities in accordance with the provisions of the regulatory legal acts of the Republic of Tajikistan.
Compliance with the established standards for the transportation of heavy and bulky goods is under strict control, and if violations are detected, administrative penalties are applied in accordance with the Code of Administrative Offenses of the Republic of Tajikistan. In cases of repeated commission of such actions by individuals and legal entities or the detection of serious violations leading to the destruction of roads, the materials are sent to the Prosecutor’s office and other law enforcement agencies for further consideration and additional legal measures.
